Please read these Terms and Conditions carefully before using the BiziCall service. By accessing or using our service, you agree to be bound by these terms. If you do not agree, please do not use the service.
1. Acceptance of Terms
By creating an account or using any part of the BiziCall platform, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. These Terms constitute a legally binding agreement between you and BiziCall, Inc.
2. Description of Service
BiziCall provides cloud-based business phone number services including, but not limited to, US virtual phone numbers, call forwarding, SMS messaging, browser-based calling, and related communication tools (collectively, the "Service").
3. Account Registration
You must provide accurate, complete, and current information when registering for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@bizicall.com if you suspect unauthorised access to your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes. You may not use the Service to:
- Make unsolicited marketing or spam calls/messages in violation of applicable law (including TCPA and CAN-SPAM);
- Engage in fraudulent, abusive, or harassing communications;
- Transmit malware, viruses, or other malicious code;
- Impersonate any person or entity;
- Violate any local, national, or international law or regulation;
- Resell or sublicense the Service without our prior written consent.
We reserve the right to suspend or terminate accounts found to be in violation of this policy without prior notice.
5. Payments, Billing & Refunds
BiziCall operates on a prepaid, pay-as-you-go model. You top up your balance and are charged for usage (calls, SMS, number rental fees) as it occurs. All charges are in US Dollars. Prices are subject to change with reasonable notice. You are responsible for ensuring your account maintains a sufficient balance to continue using the Service.
Non-refundability: All payments made to BiziCall are non-refundable. You are not entitled to any refund of payments except in the limited case of an erroneous charge directly caused by a provider-side error, which is handled at BiziCall's sole discretion. The following are never eligible for refund: payments made with prepaid cards; charges arising from your own error or omission; fraud not attributable to BiziCall; phone number monthly rental costs; and short code or messaging campaign costs. Third-party infrastructure: Our telephony services are delivered via SignalWire. Your use of those services is also subject to SignalWire's Cloud Agreement. By using BiziCall, you acknowledge that network-level charges once incurred cannot be reversed.
6. Intellectual Property
All content on the BiziCall platform — including the website, software, logos, and documentation — is the property of BiziCall, Inc. and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our express written permission.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
8. Limitation of Liability
To the fullest extent permitted by law, BiziCall, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of — or inability to use — the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid to BiziCall in the 90 days preceding the claim.
9. Termination
You may cancel your account at any time by contacting support. We reserve the right to suspend or terminate your account at our discretion if you breach these Terms or for any other reason with reasonable notice. Upon termination, your access to the Service will cease. Any remaining account balance is subject to our Refund Policy — in most cases unused balances are non-refundable.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform. Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in San Francisco County, California.
